Terms and Conditions

1. Introduction

Welcome to Yencor, a car-hailing service ("App"). By accessing or using our services, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you (the "User") and Yencor Technologies Ltd. ("Company", "We", "Us").

2. Definitions

  • Rider: A user who requests transportation services through the App.
  • Driver: A user who provides transportation services through the App.
  • Platform: The software and infrastructure that facilitate the connection between Riders and Drivers.
  • Third Parties: External service providers such as Google Maps, AI analytics, and payment processors.

3. User Eligibility & Registration

  • Users must be at least 18 years old to create an account.
  • Users agree to provide accurate and complete information during registration.
  • The Company reserves the right to suspend or terminate accounts for fraudulent activities or misuse.

4. Service Scope

  • Yencor connects Riders and Drivers for transportation services.
  • The service is initially launched in Ghana but will expand globally.
  • The Company does not own vehicles or employ Drivers; all Drivers operate independently.

5. Driver & Vehicle Requirements

  • All Drivers and vehicles must comply with local laws and regulations.
  • In Ghana, this includes compliance with the Driver and Vehicle Licensing Authority (DVLA) requirements.
  • Vehicles must pass safety inspections and possess necessary permits.
  • Drivers must hold a valid driver’s license, vehicle insurance, and any required operational permits.

6. Fees & Payments

  • Riders are charged for each trip based on distance, time, and demand.
  • A Digital Transport Fee (DTF) of GHC 1 per trip applies, as mandated by the DVLA.
  • Payment transactions are processed via third-party payment providers.

7. Third-Party Services

  • Google Maps: Used for navigation and location services. By using our App, you agree to Google’s Terms of Service.
  • Artificial Intelligence: AI is used for optimizing routes, matching Riders and Drivers, and fraud detection.
  • Payment Providers: Financial transactions are handled by third-party processors, and their respective policies apply.

8. User Conduct

  • Users must not:
    • Engage in illegal activities using the App.
    • Use the App for transporting illegal substances or hazardous materials.
    • Misuse or manipulate the platform for fraudulent purposes.

9. Data Collection & Sharing

  • The App collects user data such as trip history, GPS location, and payment details.
  • Certain data is shared with the DVLA as required by Ghanaian law.
  • Third-party services like Google Maps and AI analytics also collect user data.

10. Limitation of Liability

  • Yencor is not responsible for delays, accidents, or disputes between Riders and Drivers.
  • Third-party services such as Google Maps and payment processors operate independently, and we are not liable for their errors or failures.

11. Modifications to Terms

  • These Terms may be updated at any time.
  • Users will be notified of significant changes, and continued use of the App implies acceptance.

12. Governing Law

  • These Terms are governed by the laws of Ghana.
  • Any disputes arising from these Terms will be settled in Ghanaian courts.
